These Terms of Service ("Terms") govern your use of ackdelay ("the service", "we", "us"). By creating an account or using the service, you agree to these Terms. If you don't agree, please don't use the service.
1. The service
ackdelay is a network-operations homepage and a set of network and developer tools, including a customizable dashboard, utilities, notes, and on-demand monitoring. The service is provided as-is and may change, add, or remove features over time.
2. Accounts
- You must provide accurate information and are responsible for keeping your credentials secure.
- You are responsible for all activity that occurs under your account.
- You must be old enough to form a binding contract in your jurisdiction (at least 13, or the applicable minimum age).
3. Acceptable use
You agree not to misuse the service. In particular, you must not:
- Use the network tools or monitoring (ping, DNS, port checks, scans, etc.) against any system, host, or network you do not own or do not have explicit permission to test. You are solely responsible for ensuring you are authorized to probe any target you enter.
- Use the service for any unlawful, harmful, fraudulent, or abusive purpose, or to attack, overload, disrupt, or gain unauthorized access to any system.
- Attempt to disrupt, overload, reverse-engineer, or circumvent the security or rate limits of the service.
- Upload or store content that is illegal, infringing, malicious, or that violates the rights of others.
- Resell or commercially exploit the service without our permission.
We may suspend or terminate accounts that violate these rules.
4. Your content
You retain ownership of the content you create on ackdelay (your links, notes, images, monitors, and settings). You grant us the limited rights necessary to host, store, and display that content back to you in order to operate the service. You are responsible for your content and confirm you have the right to use it. We may remove content that violates these Terms.
5. Third-party services
Some features rely on or query third-party services (for example, IP-geolocation, DNS resolvers, weather data, and the public hosts you choose to monitor). We don't control those services and aren't responsible for their availability, accuracy, or content. Your use of them may be subject to their own terms.
6. Disclaimers
THE SERVICE, INCLUDING ALL TOOLS, WIDGETS, MONITORING, AND STATUS INFORMATION, IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do not warrant that the service will be uninterrupted, error-free, secure, or accurate.
In particular, the monitoring, reachability, latency, certificate, and other results, and any uptime or status indicators, are provided for convenience only, are not guaranteed to be accurate or available, and must not be relied upon as your sole source for operational, safety, security, or business-critical decisions. Always verify with authoritative sources.
7. Limitation of liability
To the maximum extent permitted by law, ackdelay and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of (or inability to use) the service. Our total liability for any claim relating to the service will not exceed the amount you paid us, if any, in the twelve months before the claim.
8. Termination
You may stop using the service and delete your account at any time. We may suspend or terminate access if you violate these Terms or to protect the service. Provisions that by their nature should survive termination (such as disclaimers and limitations of liability) will survive.
9. Changes to these Terms
We may update these Terms from time to time. We'll update the "Last updated" date and, for material changes, take reasonable steps to notify you. Continued use after changes means you accept the updated Terms.
10. Governing law
These Terms are governed by the laws of [your jurisdiction], without regard to conflict-of-laws rules. Any disputes will be handled in the courts of [your jurisdiction].
